Overview

These Terms and Conditions govern your use of the April March Fitness website (aprilmarchfitness.ca) and the personal training services provided by April March Fitness. By accessing this website or engaging our services, you agree to be bound by these terms.

Please read this document carefully. If you do not agree with any part of these terms, you should not use this website or engage our services.

1. About April March Fitness

April March Fitness is a sole proprietor personal training business operated by April March, based in the Kitchener-Waterloo region of Ontario, Canada.

2. Eligibility and Health Screening

2.1 All new clients are required to complete the 2023 PAR-Q+ (Physical Activity Readiness Questionnaire for Everyone) prior to beginning any training program. Training will not commence until a completed PAR-Q+ has been received and reviewed.

2.2 If your PAR-Q+ responses indicate that medical clearance is required before physical activity, you agree to obtain written clearance from a qualified healthcare provider before your first session. April March Fitness reserves the right to decline service until such clearance is provided.

2.3 You are responsible for disclosing any and all health conditions, injuries, medications, or physical limitations that may affect your ability to safely participate in physical activity. Failure to disclose relevant health information releases April March Fitness from any liability arising from injury or adverse health events related to that undisclosed information.

2.4 PAR-Q+ screening is valid for 12 months. You agree to notify April March Fitness immediately if your health status changes at any time during your training program.

3. Assumption of Risk

3.1 You acknowledge that participation in personal training and physical activity involves inherent risks, including but not limited to muscle soreness, injury, cardiovascular stress, and in rare cases, serious injury or death.

3.2 By engaging the services of April March Fitness, you voluntarily assume all risks associated with physical activity and exercise programming, whether conducted in person or online.

3.3 You confirm that you are physically capable of participating in exercise and that your participation is voluntary.

4. Liability Waiver

4.1 To the fullest extent permitted by applicable law, April March Fitness and April March shall not be held liable for any injury, loss, damage, or adverse health event arising from your participation in personal training services, whether caused by negligence or otherwise.

4.2 This waiver applies to in-person training, online training, self-directed programming provided by April March Fitness, and any exercises performed at your own initiative based on instruction or demonstration.

4.3 Nothing in these terms limits liability for gross negligence or intentional misconduct.

Note: April March Fitness recommends that all clients consult with their physician or healthcare provider before beginning any new exercise program, regardless of PAR-Q+ clearance status.

5. Services

5.1 April March Fitness offers personal training services including in-person training, online training, custom programming, and related fitness coaching. The specific scope of services will be outlined at the time of engagement.

5.2 April March Fitness reserves the right to modify, suspend, or discontinue any service offering at any time with reasonable notice to active clients.

5.3 April March Fitness is not a medical provider. Services provided do not constitute medical advice, diagnosis, or treatment. Any health-related recommendations are general fitness guidance only and are not a substitute for advice from a qualified healthcare professional.

6. Packages, Payment, and Fees

6.1 Fees for services are communicated directly to clients prior to engagement. Current rates and packages are available upon request.

6.2 Payment terms, accepted methods, and package structures will be confirmed in writing at the time of booking.

6.3 All fees are quoted and charged in Canadian dollars.

6.4 Packages are non-transferable and may not be shared between individuals.

6.5 April March Fitness reserves the right to adjust pricing with reasonable advance notice. Any rate changes will not apply to pre-purchased packages already paid in full.

7. Cancellation and Rescheduling Policy

7.1 We understand that schedules change. We ask that you provide a minimum of 24 hours' notice to cancel or reschedule a session.

7.2 Sessions cancelled with less than 24 hours' notice may be forfeited or charged at the full session rate, at the discretion of April March Fitness.

7.3 Sessions cancelled by April March Fitness will be rescheduled at no penalty to the client.

7.4 Repeated late cancellations or no-shows may result in a requirement to prepay future sessions or termination of the training relationship at the discretion of April March Fitness.

8. Expiry of Purchased Sessions

8.1 Pre-purchased session packages must be used within 3 months of the purchase date unless otherwise agreed in writing.

8.2 Expired sessions are non-refundable unless expiry is due to a medical condition supported by documentation from a qualified healthcare provider.

9. Refund Policy

9.1 Refunds on pre-purchased packages are considered on a case-by-case basis. Unused sessions may be refunded on a pro-rated basis at the request of the client, less any applicable administrative fee.

9.2 Sessions already delivered are non-refundable.

9.3 Refund requests must be submitted in writing to aprilmarchfitness@outlook.com.

10. Online Training

10.1 Online training is delivered via Zoom, Microsoft Teams, Google Meet, or other agreed-upon platforms to accommodate technology. Clients are responsible for ensuring they have access to a compatible device, a stable internet connection, and adequate space to exercise safely.

10.2 April March Fitness is not responsible for technical issues on the client's end that result in a disrupted or incomplete session. Sessions significantly disrupted by technical difficulties will be evaluated individually to determine whether a makeup session is warranted.

10.3 You are responsible for ensuring your training environment is safe, clear of hazards, and appropriate for exercise before each online session.

10.4 Online sessions may not be recorded by the client without the prior written consent of April March Fitness.

11. Referral Relationships and Third-Party Practitioners

11.1 April March Fitness maintains professional referral relationships with chiropractors, physiotherapists, registered massage therapists, and other allied health professionals. Participation in a referral relationship does not make April March Fitness an agent or employee of any referring practitioner or clinic.

11.2 If you have been referred to April March Fitness by a healthcare provider and have consented to communication between your trainer and that provider, such communication will be limited to information relevant to your fitness programming and safety.

11.3 April March Fitness does not receive or provide financial compensation in connection with client referrals unless explicitly disclosed to the client in advance.

12. Intellectual Property

12.1 All content on the April March Fitness website, including text, images, programming materials, and workout plans, is the intellectual property of April March Fitness unless otherwise stated.

12.2 Training programs, workout plans, and written materials provided to clients are for personal use only. They may not be reproduced, shared, resold, or distributed without the written consent of April March Fitness.

13. Professional Boundaries

13.1 April March is a certified personal trainer, not a registered dietitian, physiotherapist, physician, or mental health professional. Any guidance provided outside the scope of personal training is general in nature and does not replace professional advice in those fields.

13.2 Clients are encouraged to consult appropriate healthcare professionals for concerns outside the scope of fitness training.

14. Termination of Services

14.1 Either party may terminate the training relationship at any time with written notice.

14.2 April March Fitness reserves the right to terminate services immediately and without refund in cases of client conduct that is abusive, threatening, or otherwise inappropriate.

14.3 Upon termination, any unused prepaid sessions will be refunded on a pro-rated basis, subject to the terms of Section 9.

15. Governing Law

These Terms and Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms or the services provided shall be subject to the exclusive jurisdiction of the courts of Ontario.

16. Changes to These Terms

April March Fitness reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with a revised date. Continued use of this website or services following any update constitutes your acceptance of the revised terms.
