Liability Waiver and Informed Consent

1. Agreement Overview

This Liability Waiver and Informed Consent (“Agreement”) is a binding legal agreement between you (“Client”) and April March Fitness, operated by April March (“Trainer”), based in the Kitchener-Waterloo region of Ontario, Canada.

By participating in any services provided by April March Fitness—including in-person training, online coaching, group sessions, or self-directed programming—you confirm that you have read, understood, and agree to be bound by this Agreement.

2. Health Disclosure and Medical Responsibility

You agree that you have disclosed all known medical conditions, injuries, surgeries, physical limitations, symptoms, and medications that may affect your ability to safely participate in physical activity.

This includes, but is not limited to:

  • prior or recent surgeries (including spinal or neck surgery)

  • joint, muscle, or ligament injuries

  • chronic pain conditions

  • cardiovascular or neurological conditions

  • any condition affecting mobility, coordination, or balance

You confirm that:

  • You have completed the PAR-Q+ (Physical Activity Readiness Questionnaire for Everyone) honestly and in full prior to beginning training

  • You have obtained medical clearance where required

  • If you choose to participate without obtaining recommended medical clearance, you do so entirely at your own risk.

  • You agree to immediately inform April March Fitness of any changes in your health status, including new injuries, diagnoses, surgeries, pregnancies, or changes in medication.

  • April March is a certified personal trainer and is not a physician, physiotherapist, registered dietitian, registered massage therapist, or mental health professional. Nothing provided constitutes medical advice, diagnosis, or treatment.

3. High-Risk Conditions and Prior Injuries

You acknowledge that certain conditions—including prior injuries, surgeries, or chronic conditions—may significantly increase your risk of injury during exercise.

If you have disclosed or are aware of such a condition, you expressly acknowledge and agree that:

  • You are participating at an elevated level of personal risk

  • Your condition may worsen, including re-injury or permanent aggravation

  • You have either obtained medical clearance or voluntarily chosen to participate without it

  • You accept full responsibility for all outcomes related to your participation

4. Acknowledgment of Inherent Risks

Physical activity and personal training involve inherent risks that cannot be completely eliminated.

These risks include, but are not limited to:

  • muscle strains, sprains, or tears

  • joint or ligament injuries

  • dizziness, fainting, or cardiovascular stress

  • aggravation of pre-existing injuries or conditions

  • serious injury or, in rare cases, death

These risks apply across all service formats, including in-person training, online training, group sessions, and self-directed programming.

For online and self-directed training, additional risks include:

  • lack of direct supervision

  • improper use of equipment

  • inadequate training space or unsafe conditions

  • You acknowledge that if you have a pre-existing injury or prior surgery, your risk of aggravation or further injury is significantly increased—even with appropriate instruction.

  • Your participation is voluntary, and you assume all risks associated with training.

5. Client Responsibility and Self-Monitoring

You acknowledge that you are responsible for monitoring your own physical condition throughout all training.

You agree that you will:

  • immediately stop any exercise that causes pain, discomfort, dizziness, or unusual symptoms

  • inform the Trainer promptly of any concerns

  • not continue any movement that feels unsafe, regardless of instruction

You understand that the Trainer relies on your communication and cannot feel what you feel during exercise.

6. Liability Waiver and Release

To the fullest extent permitted by the laws of the Province of Ontario, you voluntarily agree to:

  • Release, waive, and discharge April March Fitness and April March from any and all claims, demands, damages, or causes of action arising from or related to your participation in training services

This includes claims arising from negligence, including but not limited to instruction, programming, supervision, or failure to modify exercises

You acknowledge and agree that:

  • You are solely responsible for determining your physical limits

  • You assume full responsibility for any injury, including aggravation of pre-existing conditions

  • This waiver applies to all services and all injuries, whether occurring during sessions or outside of sessions while following provided programming

  • You further agree to indemnify and hold harmless April March Fitness and April March from any claims brought by third parties arising from your participation.

  • Nothing in this Agreement limits liability for gross negligence or intentional misconduct.

7. Informed Consent

You consent to receiving personal training services from April March Fitness, including fitness assessments, exercise programming, movement coaching, and related guidance.

You understand that:

  • The effectiveness and safety of your program depends on the accuracy of the information you provide

  • The Trainer may modify or stop any exercise if deemed in your best interest

  • You may stop any activity at any time

  • If you have been referred by or are working with a healthcare provider, you consent to the sharing of relevant fitness information where appropriate. This consent may be withdrawn in writing at any time.

8. Online Training and Self-Directed Programming

If you participate in online or self-directed training, you accept additional responsibility for your safety.

You agree to:

  • ensure your training environment is safe and free of hazards

  • use appropriate equipment and in proper working condition

  • take full responsibility for exercises performed without direct supervision

  • April March Fitness cannot directly supervise independently performed exercises.

9. Group Training Sessions

Group training sessions are designed for general participation and may not be tailored to your specific health conditions or limitations.

You agree to:

  • modify exercises as needed based on your condition

  • communicate any limitations before and during sessions

10. Minors

If you are under the age of 18, a parent or legal guardian must provide consent prior to participation. A separate consent form may be required.

11. Photography and Testimonials

April March Fitness will not photograph, film, or record you without your explicit prior consent.

If you choose to participate in testimonials or promotional content, separate written consent will be obtained.

12. No Guarantees of Results

You acknowledge that participation in fitness training does not guarantee specific results.

You understand that:

  • results may vary

  • no improvement may occur

  • existing conditions may worsen despite appropriate training

13. PAR-Q+ Acknowledgment

By agreeing to this document, you confirm that:

  • You have completed the PAR-Q+ honestly and in full

  • Your responses are accurate and complete

  • Your PAR-Q+ forms part of this Agreement and informed consent

  • You understand that providing false or incomplete information increases your risk and may affect the enforceability of this Agreement.

14. Governing Law

This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.

15. Changes to This Document

April March Fitness reserves the right to update this Agreement at any time.

Clients will be notified of material changes and may be required to re-confirm agreement before continuing services.
